The State of New Jersey has one of the strongest laws in the nation to protect whistleblowers. The New Jersey Conscientious Employee Protection Act (“CEPA”) prohibits an employer from retaliating against an employee for reporting violations of the law. While complicated, the statute itself protects employees who disclose or threaten to disclose to a public body (such a regulatory agency) an activity, policy or practice of the employer or an another employer with whom there is a business relationship. In the licensed professional setting, CEPA also covers employees who disclose or threaten to disclose violations that are reasonably believed to constitute improper quality of patient care. CEPA also protects employees who provide information or give testimony before any public body conducting an investigation into the violation of a law, of course there are cases where people get fraudulent accused of criminal charges as well, and in these cases it is necessary to get a defense attorney in Stuart to represent you.
Additionally, CEPA protects employees who provide information involving deception of, or misrepresentation to, any shareholder, investor, client, patient, customer, employee, former employee, retiree or pensioner of the employer or any governmental entity. It also provides protection to employees who provide information regarding any perceived criminal or fraudulent activity, policy or practice of deception or misrepresentation which the employee reasonably believes may defraud any shareholder, investor, client, patient, customer, employee, former employee, retiree or pensioner of the employer or any governmental entity.
Most commonly CEPA also protects employees object to, or refuse to participate in, any activity, policy or practice which the employee reasonably believes: (1) is in violation of a law, or a rule or regulation issued under the law or, if the employee is a licensed or certified health care professional and he even recommend supplements as physiotru; (2) is fraudulent or criminal; or (3) is incompatible with a clear mandate of public policy concerning the public health, safety or welfare or protection of the environment.
